Rule 46
Provisions relating to tenure, acting and deputation
: (1) No post in the police service shall ordinarily be granted tenure. However, if the position of the head of the office is vacant, if the daily work of the office is hindered, the permanent position can be decided.
(2) In the case of cancellation of tenure in accordance with this rule, only the most senior police personnel below one level of the relevant sub-group towards the technical police group and the most senior police personnel below one level towards the district police group will be denied tenure.
(3) A police officer with a permanent position shall be entitled to use the insignia and all rights of the post of permanent position.
(4) The following officers shall hold permanent positions in the following positions:
(a) Government of Nepal in the post of Inspector General of Police and Additional Inspector General of Police.
(b) Minister of Home Affairs on the recommendation of the relevant promotion committee for the post of Deputy Inspector General of Police and Senior Superintendent of Police.
(c) Inspector General of Police with the approval of the Ministry in the post of Superintendent of Police.
(e) Deputy Inspector General of Police with the approval of Inspector General of Police in the post of Deputy Superintendent of Police and Inspector of Police.
(5) If for any reason the post of head of the office is vacant for a period of more than one month and the position is not confirmed, the head of the office one level above may appoint the most senior police officer one level below the vacant post to act as the caretaker of that post. When he is appointed as the caretaker, the notification should be given to the police head office.
(6) According to sub-section (5), the police officer assigned to work as acting officer shall be entitled to use all the rights of such acting post.
(7) If the head of the office is absent for any reason for a period not exceeding one month in the case that the permanent position has not been established or an acting officer has not been appointed in accordance with this rule, the most senior police officer of the office shall act as a substitute for that position. In this way, the entire responsibility of the period of working as an agent will be of the police officer who works as an agent.
(7a) Notwithstanding anything written in sub-rule (7), if the post of Inspector General of Police becomes vacant for any reason or if the Inspector General of Police is unable to act in that capacity for any reason, the Government of Nepal may appoint the most senior Additional Inspector General of Police to act as Acting Inspector General of Police. In this way, the entire responsibility of the period of working as an agent will belong to the Additional Inspector General of Police who is acting as an agent.
(8) A police officer working as a permanent, acting or acting officer shall be entitled to the salary allowance and ration facilities of the post in which he has worked. However, those who work as caretakers or substitutes for a period of less than fifteen days will not get such salary allowance and ration facility.
(9) The number of salary and allowances to be received by a police employee working as per sub-rule (8) shall not exceed the salary and allowances that he will receive if he is promoted to that position.
(10) No more than one police officer can be permanent or acting in any one post at the same time.
